Managing the Negotiation Within – Both Our Clients’ and Our Own Presented by David Hoffman, JD Mr. Hoffman is bringing the popular PFI he presented at the 2019 IACP Conference to DCACP. Mr. Hoffman will explain how Collaborative professionals can be most effective when we understand how to manage the emotional dimensions of the conflicts we handle. Psychologists have long understood that individuals have sub-personalities, each seeking to guide our thinking and behavior – for example, angry parts that respond when provoked, managerial parts that help us resolve conflicts, and wounded, exiled parts that carry our fears and pain. With a particular focus on Internal Family Systems (IFS) theory, this workshop will help professionals (a) understand the various ‘parts’ that show up in us when we are involved in conflict, (b) manage this internal negotiation in ourselves so that we can be more effective in our cases, and (c) teach these techniques to our clients. David Hoffman is a Collaborative Practice attorney, mediator, arbitrator, and founder of Boston Law Collaborative, LLC. He is also the John H. Watson, Jr. Lecturer on Law at Harvard Law School, where he teaches courses on mediation, diversity, Collaborative Law and legal ethics. He is past chair of the ABA Section of Dispute Resolution, and a founding member of the Massachusetts Collaborative Law Council. The Lost Art of Asking: Finding Out What Matters Presented by Jacinta Gallant, JD Conflict resolution professionals need strong communication skills and the ability to be productively curious. We ask questions to aid in understanding. We intend to be helpful and open, so when we get a defensive or resistant reaction we often wonder, “What went wrong?”. This workshop will help collaborative professionals ask better questions to find out what matters. We’ll explore questions like: • What does it mean to ask and listen to understand? • How do we get the conversation started – and keep the dialogue going? • What should we be asking about? • How can we use questions to find creative solutions tailored to the clients’ needs? • How can the collaborative team focus on what matters to the clients in option generation? Finally, professionals will learn to use this information to create a “Decision-Making Agenda” that aids clients and the team in generating options that meet the clients’ unique needs and values.
